Is America turning into a Banana Republic?
According to a leaked initial draft of Supreme Court Justice Samuel Alito’s majority opinion released on the night of May 2, 2022, the Supreme Court ruled to overturn Roe v. Wade.
Politico first published the report, which has caused massive outrage across the political spectrum.
The report stated the following:
The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.
…A person familiar with the court’s deliberations said that four of the other Republican-appointed justices – Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett – had voted with Alito in the conference held among the justices after hearing oral arguments in December, and that line-up remains unchanged as of this week.
According to the draft opinion, the court “reverses the Court of Appeals’ judgment” and “vacates its decision in Whole Woman’s Health v. Hellerstedt.”
In essence, Roe v. Wade would be overturned, thereby giving states, especially red states, the ability to prohibit abortion.
So far, the SCOTUS opinion has not been made official and could still be changed. Nevertheless, the anti-life Left is freaking out. They’re dedicated to making abortion completely accessible and any move to limit abortion, such as the overturning of Roe v. Wade, would be treated as a devastating blow for their agenda.
While this leak shows that the SCOTUS still believes in the right to life and constitutional jurisprudence, it also represents a major blow to the institution’s legitimacy.
The SCOTUS has been heavily politicized since the Warren Court, as evidenced by its judicial activism and its tendency to legislate from the bench. Now, with this leak, trust in this institution has only deteriorated.
The fact that such sensitive information was leaked to the corporate press is bone-chilling. It also sets a troubling precedent where leakers can go around and send sensitive information to the media in efforts to blackmail and intimidate public officials.
The leaker is suspected to be a progressive law clerk with an axe to grind. This behavior is in line with the Left’s goal to tear apart political and social norms. All of this is designed to generate chaos, one of the end goals of the cultural Left.
Missouri Senator Josh Hawley shared his take on the matter: “The left continues its assault on the Supreme Court with an unprecedented breach of confidentiality, clearly meant to intimidate. The Justices mustn’t give in to this attempt to corrupt the process.”
The intentions of the leaker is the subject of mass speculation. Some believe that the goal was to pressure the justices originally in favor of overturning Roe to change their decision. Chief Justice John Roberts would be the most likely to switch based on his track record.
In light of this leak, the abortion issue has re-entered the center stage of public discussion, which will undoubtedly evoke strong emotions on both sides.
In the immediate aftermath of this leak, the Democratic National Committee started blasting out fundraising texts to capitalize on the outrage this action provoked.
The DNC and pro-baby killing activists will be raking in bucks and getting plenty of media attention thanks to this leak.
However, America’s institutional health has taken a devastating blow. Now, future leakers and other subversives can employ similar tactics to intimidate and blackmail their opposition.
This is stuff that’s province of Banana Republics and other countries where the rule of law is not protected. As the US continues its social and political decline, we can expect similar incidents of this nature to continue occurring.
